TPS for Haitians: Judge Ana C. Reyes maintains her decision and warns Trump administration

Washington, February 12, 2026.- At a hearing held this Thursday, February 12, followed at a distance, Federal Judge Ana C. Reyes strongly rejected the request of the government's lawyers to set aside its decision in favour of maintaining the Temporary Protection Status (TPS) for Haitian nationals.

The judge recalled that the administration may refer the matter to the Court of Appeal if it wishes to challenge the judgement, but stressed the enforceability and finality of its decision at this stage. She warned that heavy sanctions could be imposed on the Trump administration if the Department of Homeland Security (DHS) refused to implement its order. A written decision is expected before February 19, according to LSV citing CTN.

During the hearing, Reyes J. also stated that there are no legal obstacles preventing GST recipients from renewing their driving licences. It ordered the DHS to issue clear guidelines for motor vehicle services across the country to ensure compliance with this right.

In a firm statement, the magistrate stated that she would not yield to any external pressure. She has revealed numerous death threats since her decision was issued, also targeting her family. According to him, some individuals publicly insulted and attacked him. Despite this tense climate, Judge Ana Reyes reiterated her commitment to independent law enforcement.
