Controversial revocation: FNE DG seizes CCSCA for overpowering

Sterline Civil, Director General of the National Education Fund (FNE), appointed on 18 February 2025, claims to have been revoked on 18 September for refusing to divert the money destined for schooling. In an appeal for excess of power addressed to the President of the Superior Court of Accounts and Administrative Litigation (CSCCA), Rogavil BOISGUÉÉ, on Thursday 18 September, she asks for the annulment of the decision, its immediate reinstatement and compliance with Article 21 of the Organic Law of the FNE, which guarantees a three-year term.

An arbitrary decision, according to Sterline Civil

In her letter of appeal, Ms Civil denounced a revocation without a legal basis: no charges of corruption, no moral or physical impediment, no serious breach, and above all no adversarial proceedings. It states that the decision, which was not substantiated and in violation of the texts, would be linked to its refusal to participate in attempts to misappropriate the funds of the NEF.

Legal argument: protection of the mandate

Created by law, the FNE enjoys administrative and financial autonomy. The Director General is appointed by decree to the Council of Ministers, on the proposal of the Minister responsible, for a three-year term. According to Ms. Civil, her dismissal clearly violated article 21 of the Organic Law, which stipulated that there was no provision allowing such a decision outside the cases expressly provided for. It therefore asks the CSCC to declare the act null and void and to order its reinstatement.

For Sterline Civil, this case symbolizes an institutional and civic struggle. It believes that accepting such revocation would undermine legal certainty, discourage young managers and legitimize administrative arbitrariness. « It's not just my person, it's the future of our institutions and Haitian youth », she writes.

Ms. Civil concluded by asking that this case serve as a protective precedent for future generations: « No more arbitrary, no more confiscation of merit and law. » It calls on the Republic to defend the exemplary nature of the public service, an essential condition for restoring confidence and ensuring access to quality education.

According to the latest information, the Transition Presidential Council has chosen Elysée Colagen as the new Managing Director of the National Education Fund (NEF).
