New penal and criminal procedure codes: the Executive temporise to avoid legal insecurity

Port-au-Prince, 24 December 2025.- The members of the Council of Ministers, meeting in special session, decided to postpone the entry into force of the new Penal and Criminal Procedure Codes. Acted by decree, this measure aims to prevent any legal uncertainty and to allow for the progressive and better supervised implementation of these major laws.

The Haitian Executive officially postponed the entry into force of the new revised Penal and Criminal Procedure Codes. The announcement was made this Wednesday by the Prime Minister's Communications Office, following a special meeting of the Council of Ministers held by videoconference on Wednesday 24 December.

The meeting was chaired by the President of the Presidential Council of Transition, Laurent Saint-Cyr, in the presence of Prime Minister Alix Didier Fils-Aimé. The postponement was formalised by decree, which also specifies the various phases envisaged for the progressive implementation of these legal reforms.

According to the authorities, the main aim of this decision is to avoid any legal uncertainty which could undermine the rights of litigants and the proper functioning of the rule of law. It should also enable judicial actors to better prepare for the entry into force of the new provisions.

The Department of Justice and Public Safety will thus be given additional time to put in place an adequate technical and operational mechanism to coordinate, supervise and pilot the orderly application of the new Codes.

The Transitional Presidential Council and the Government also reaffirm their common desire to strengthen the rule of law and ensure the smooth functioning of republican institutions.
