Mr. Guerby Blaise
Invited to the show Panel Magik on Radio Magik 9, this Tuesday, December 30, 2025, Mr. Guerby Blaise strongly criticized the draft decree on the operation of the High Court of Justice. He denounces the absence of « substantive intellectual work »A text which he considered tailored to personal political interests and which he considered a serious threat to the rule of law. The lawman reveals that he refused to validate the document and warned presidential adviser Emmanuel Vertilaire that he would withdraw from the file in case of signature.
A solid doctrinal groundless decree
According to Mr. Guerby Blaise, the draft decree is based on a simple mechanical adaptation of articles 186 and 189 of the Constitution, without thorough legal reflection or institutional coherence.
« The editors used these articles and adapted them to a situation, to the personal interests of the political authorities. », he said, questioning the light methodology and political background of the text.
A direct threat to the rule of law
For the lawman, this executive approach constitutes a structural danger to Haitian justice. By weakening the normative framework of the High Court of Justice, the decree might undermine judicial independence and undermine the sustainability of the rule of law.
The duty of the lawyer to the power
Mr. Guerby Blaise recalled that one of the fundamental roles of the lawyer was the protection of the rule of law, including when it involved opposing the political authorities.
« Whenever the rule of law is threatened, the lawyer must demand respect for it, even if it is against the personal interests of the leaders. », he insists on the waves of Magik 9.
Refusal of validation and political warning
